(doing business as "Franchise Arbitration and Mediation Services" & "FAM")
is an arbitration and mediation referral service specializing in the resolution of disputes between franchisors and franchisees or otherwise involving franchising issues, using alternative dispute resolution techniques.
WHAT IS FAM AND WHAT DOES IT DO?
FAM was originally established in 1988 to meet a need in the franchising community for
neutral arbitrators to resolve disputes between franchisors and franchisees. Other
arbitration organizations lacked franchise expertise on its panels, resulting in
unnecessary added costs, as the arbitrators were "educated" about franchise statutes,
regulations and case law. Many were not attorneys yet were empowered to render binding
arbitration awards. Each member of FAM's arbitration panels is an attorney in good standing
with at least five years of practice concentrating on franchise law. Most are members of the prestigious American Bar Association
Forum on Franchising and many have lectured extensively on franchise law and franchise-related
issues.
FAM MISSION STATEMENT
FAM exists to:
- Develop processes and procedures that facilitate alternative dispute resolution between franchisors and franchisees;
- Provide an organization whose arbitrators and mediators have the expertise to efficiently resolve franchise disputes;
- Establish and implement criteria for the determination of the skills and abilities of its panelists and prospective panelists; and
- Establish and enforce among its panelists the highest standards of impartiality, competence and integrity.
